2. Products are only repairable/ returnable within the applicable return window that is within 48 hours of delivery which is applicable only if you’ve received them in a condition that is physically damaged, has missing parts or accessories, defective or different from their description on the checkout page.

3. Return will be processed only if:

• it is determined that the product was not damaged while in your possession;
• the product is not different from what was shipped to you;
• the product is returned in original condition (with brand’s/manufacturer's box, MRP tag intact, user manual, warranty card and all the accessories therein).

4. Products may not be eligible for return in some cases, including cases of buyer's remorse such as incorrect model or color of product ordered or incorrect product ordered.

5. Actual product color shades might vary in reference to product shown on website.

6. Product liability shall in no event exceed the MRP of the product.

7. The decision of Monki Space Private Limited to repair / replace the product shall be final and conclusive for all purposes.

8. All costs for transport and freight of the product to Monki Space Private Limited Customer Care center will be borne by the customer.

9. Monki Space Private Limited does not offer any warranties against deterioration of product due to wear and tear, damage due to use of chemicals or corrosion, customer mishandling, tampering.

10. This warranty shall be void if the customer approaches any third party to rectify the defect relating to Monki Space Private Limited product for whatsoever reasons.

11. The price of our products is as quoted on the Site from time to time. Prices include GST but exclude delivery costs, which will be automatically added (at the cost shown) to the total amount due when you view the items in your shopping basket and have selected your chosen delivery method. Prices and delivery costs are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a dispatch Confirmation. The site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on the site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that where a product's correct price is less than our stated price, we will charge you the lower amount. If any of the Monki Space Private Limited's product's correct price is higher than the price stated on the site, we will normally, at our discretion, either contact you for instructions before dispatching the product or reject your order and notify you of such rejection. Payment for all orders must be made by credit or debit card on the checkout page. We accept payment by most major credit and debit cards. You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declined to authorize payment for any reason. We also carry out a standard pre-authorization check on your payment card, and Monki Space Private Limited’s products will not be dispatched until this pre-authorization check has been completed. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee. We are not responsible for this.

12. While availing any of the payment method/s available on the Website, Monki Space Private Limited will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly because of:

• Lack of authorization for any transaction/s, or
• Exceeding the pre-set limit mutually agreed by You and between “Bank/s”, or
• Any payment issues arising out of the transaction, or • Decline of transaction for any other reason/s

13. These Terms of Sale are subject to revision at any time and hence Buyers are requested to carefully read these Terms from time to time before making any purchase of the Products. The revised Terms of Sale shall be made available on the Website. If such a facility is provided, you may determine when these Terms of Sale were last modified by referring to the "Last Updated" legend provided above.

14. Buyers are requested to regularly visit the Website to view the most current Terms of Sale. It shall be Buyer’s responsibility to check these Terms of Sale periodically for changes.

15. Subject to the applicable law, in no event shall Monki Space Private Limited or its officers, employees, shareholders, or agents (A) be held liable to the user with respect to the use of the sites, the content or the materials contained in or accessed through the sites (including without limitation any damages caused by or resulting from reliance by a user on any information obtained from Monki Space Private Limited), or any damages that result from mistakes, omissions, interruptions, deletion of files or email, errors , defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of God, communications failures, theft, destruction, or unauthorized access to Monki Space private Limited's records, programs or services; and (B) be liable to the user for any indirect, special, incidental, consequential, punitive or exemplary damages, including, without limitation, damages for loss of goodwill, Lost profits, loss, theft or corruption of user information or the inability to use the sites or any of their features. The user's sole remedy is to cease use of the sites.

16. Any claim under these Terms of Use must be brought within 1 (One) year after the cause of action arises, or such claim or cause of action is barred. In the event of any controversy or dispute between Monki Space Private Limited and you arising out of or in connection with your use of the Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation to be governed under the Arbitration and Conciliation Act, 1996. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable laws of India and they shall be subject to jurisdiction of the courts of Delhi, India.
